These Terms of Service ("Terms") govern your use of the SANKA mobile application and website (collectively, the "Service") operated by Sanka ("we", "our", or "us"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use SANKA. By using the Service you represent that you meet this age requirement. If you are under 18, your parent or guardian must review and agree to these Terms on your behalf.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and truthful information when registering.
- Notify us immediately of any unauthorized use of your account at hello@sanka.world.
- Not share your account with any other person.
- Not create multiple accounts to evade a suspension or ban.
3. Acceptable Use
You agree to use SANKA only for lawful purposes. You must not:
- Send spam, unsolicited bulk messages, or automated messages without consent.
- Harass, threaten, bully, or intimidate other users.
- Share content that is illegal, obscene, defamatory, or that violates any third-party rights.
- Abuse the SOS feature by sending false emergency alerts.
- Use the location features to stalk, track, or surveil another person without their consent.
- Attempt to reverse-engineer, decompile, or hack the Service.
- Interfere with the integrity or performance of the Service or its underlying systems.
Violating these rules may result in immediate account suspension or termination.
4. Location Features
SANKA's location features (SANKA Ping, Live Location, SOS alerts, Guardian Mode) rely on explicit, user-initiated sharing. You acknowledge that:
- You consent to sharing your location with specific users when you activate these features.
- You will only use Guardian Mode with the full knowledge and consent of all parties involved.
- Misuse of location features to track someone without their consent is a violation of these Terms and may be illegal.
- False SOS alerts may be reported to emergency services and may result in account termination.
5. Content You Share
You retain ownership of content you post on SANKA (messages, photos, files). By using the Service, you grant us a limited, non-exclusive license to store, transmit, and display your content solely to operate and improve the Service.
You are solely responsible for the content you share. We do not endorse or guarantee the accuracy of any user-generated content.
6. Subscriptions and Payments
SANKA may offer premium subscription tiers ("SANKA Pro") with additional features. Subscriptions are billed through the Apple App Store or Google Play Store and are subject to those platforms' payment terms.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the billing period.
- Refunds are handled by the respective app store platform, not by SANKA directly.
- We reserve the right to change subscription pricing with advance notice.
7. Termination
You may delete your account at any time from the app settings. We may suspend or terminate your account if you violate these Terms, with or without prior notice.
Upon termination, your right to use the Service ceases immediately. Data deletion following account closure is governed by our Privacy Policy.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
The SOS and crash detection features are designed as supplemental safety aids — they are not a substitute for calling emergency services (911 or your local equivalent) directly in an emergency.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SANKA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Governing Law
These Terms are governed by the laws of the jurisdiction in which Sanka is incorporated, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
11. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes through the app or by email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
